Can You Use Copyrighted Music in Clips?

Platform music libraries are licensed for personal posts but usually not commercial ones. What that means for clips submitted to paid campaigns.

This trips up more clippers than any other rights question, because the answer changes depending on whether the post counts as commercial — and a clip submitted to a paid campaign usually does.

What the in-app libraries actually license

TikTok, Instagram and the rest offer large catalogues of popular music inside the app. Those licences generally cover personal, non-commercial posting. The moment a post is promotional, or you are being paid for it, most of that catalogue falls outside what the licence permits.

Platforms maintain separate commercial libraries — smaller, less fashionable, and cleared for business use. That is what a brand account is expected to use, and it is the safer choice for campaign work.

Where a campaign clip sits

If you are being paid per view for a clip promoting someone's content, treating that as a personal post is optimistic. The conservative reading, and the one that avoids a takedown mid-campaign, is that campaign clips are commercial and should use commercially cleared audio.

  • Original audio from the source content: always the safest, and usually better anyway.
  • The platform's commercial library: cleared, if less trendy.
  • Licensed stock music: fine, keep the licence.
  • Trending chart music from the personal library: risky on a paid clip.

Why original audio is usually the right answer

For clips of podcasts, interviews and streams, the speech is the content. Music over the top competes with the thing people are meant to be listening to, and captions plus clear speech outperform a trending track in nearly every case. The rights question mostly disappears if you simply do not add music.

What happens when you get it wrong

Usually the audio is muted or the clip is regionally blocked rather than the account being penalised — but a muted clip earns nothing on a campaign, and a blocked one earns nothing in the blocked region. The cost lands on you either way.
